Chain of Responsibility is an Australian law that extends legal responsibility for road safety beyond drivers to all parties in the transport chain. This includes consignors, consignees, loaders, unloaders, schedulers, and operators. Each party must take reasonable steps to prevent breaches related to fatigue, speed, mass, dimension, and load restraint.
Category 1 offences (most serious) carry penalties up to $300,000 plus 5 years imprisonment for individuals, or up to $3.55 million for corporations (NHVR 2025). Lower categories carry proportionally reduced penalties. Directors and executives can be held personally liable if they failed to exercise due diligence.
Under the HVNL, drivers can use either a compliant paper work diary or a TCA certified electronic work diary (EWD). EWDs are not mandatory, but they offer significant advantages: automatic time recording to the nearest minute, reduced errors, and simplified audit processes. Many operators choose EWDs to reduce administrative burden and improve compliance accuracy.
You should maintain records of driver work hours and rest breaks, vehicle maintenance and pre-start checks, load weights and documentation, scheduling and delivery timeframes, training records, and any risk assessments or safety procedures. Records should be kept for at least 3 years and be readily available for inspection.

Standard Hours apply by default and have the most restrictive work and rest requirements. Basic Fatigue Management (BFM) allows additional flexibility with operator and driver accreditation. Advanced Fatigue Management (AFM) provides maximum flexibility but requires comprehensive risk management systems, training, and auditing. Each level requires progressively more sophisticated fatigue management practices.
